 Ukraine: UN General Assembly Demands Russia Reverse Course On 'Attempted Illegal Annexation' 

 

 

"The UN General Assembly passed a resolution by a large majority on Wednesday, calling on countries not to recognise the four regions of Ukraine which Russia has claimed, following so-called referendums held late last month, and demanding that Moscow reverse course on its "attempted illegal annexation".

The results were 143 Member States in favour, with five voting against, and 35 abstentions. The countries who voted against were Belarus, the Democratic People's Republic of Korea, Nicaragua, Russia and Syria.

A majority of those countries abstaining were African nations, alongside China and India.

The resolution “defending the principles” of the UN Charter, notes that the regions of Donetsk, Kherson, Luhansk and Zaporizhzhia are temporarily occupied by Russia as a result of aggression, violating Ukraine’s territorial integrity, sovereignty and political independence.

The General Assembly automatically took up the resolution for debate, triggered by Russia’s use of the veto in the Security Council over it’s attempted annexation.

Immediate reversal

The resolution now passed in the Assembly, calls on all States, the UN and international organisations not to recognize any of Russia’s annexation claim and demands the immediate reversal of its annexation declaration.

The resolution welcomes and “expresses its strong support” for the continued efforts by the Secretary-General and Member States, to de-escalate the current situation in search of peace through dialogue, negotiation and mediation.

The debate over the Ukrainian resolution began on Monday, with the General Assembly President Csaba K艖r枚si telling the world’s most representative deliberative body that the UN Charter, the Secretary-General, and the Assembly itself had been clear – Russia’s invasion, and attempted annexation of Ukrainian territory by force, “is illegal”.

Civilian areas bombarded

Since Monday morning, Russia has launched dozens of missiles targeting civilian areas of multiple Ukrainian cities, leading to dozens of deaths and injuries, in retaliation for the bombing of Russia’s bridge to Crimea on Saturday. UN Secretary-General Ant贸nio Guterres said the assault was “another unacceptable escalation” in Russia’s February 24 invasion of its neighbour.

Speaking at the start of the debate on Monday, Mr. K艖r枚si said that “when it becomes a daily routine to watch images of destroyed cities and scattered bodies, we lose our humanity…We must find a political solution based on the UN Charter and the international law.”

Secret ballot rejected

The debate began with a procedural vote on a measure which Russia had flagged, proposing that the Ukrainian draft resolution being debated, be voted on by secret ballot, not through an open recorded vote.

The Albanian proposal received 107 votes in favour, with 13 against, and 39 abstentions, with the country’s representative arguing that it would establish a “dangerous precedent” if such a substantive issue of peace and security was voted on in secret."

" JUAN RAM脫N DE LA FUENTE RAM脥REZ (Mexico) said his delegation will vote in favour of today’s draft text, a position grounded in support for stringent compliance with United Nations principles.  Mexico has been a victim of invasions and cannot allow other countries to fall victim to such acts of aggression.  There is no place for false dichotomies, he said, adding that one principle cannot be upheld while another violated.  For example, the right to self-determination cannot violate the principle of sovereignty and territorial integrity.  The so-called referenda held by the Russian Federation lack all legal standing.  Given that a referendum was held during an armed conflict, any expression of popular will is null and void.  It is not possible through a veto to eliminate or discredit international norms and legal institutions, he added, encouraging Member States to consider suspending the use of the veto in incidents of mass atrocities."

 "With 145 votes in favor -including that of Mexico-, 5 votes against and 35 abstentions, the General Assembly of the United Nations Organization (UN) approved, on October 12, 2022, a resolution that condemns the illegal annexation of the Ukrainian regions of Donetsk, Lugansk, Kherson and Zaporizhia, by Russia, after considering it a violation of the founding charter of the international organization, signed in 1945.

"The General Assembly condemns the fact that the Russian Federation has organized 'referendums', illegal in itself, in regions located within the internationally recognized borders of Ukraine and the attempted illegal annexation of Ukrainian regions", indicates the approved resolution .

The Permanent Mission of Mexico to the United Nations -led by Ambassador Juan Ram贸n de la Fuente Ram铆rez-, voted in favor of condemning Russia, despite the fact that on October 10, 2022, President Andr茅s Manuel L贸pez Obrador reiterated that his Government maintains a neutral position in the face of the war between the Russians and the Ukrainians.

“That they do not include us in their arguments. To us that they do not get involved in their affairs, Mexico has a policy of neutrality and what we want is a peaceful solution to that controversy, as established by our Constitution, "said the Tabasco politician.

“I saw that even former President [Donald] Trump is already proposing that peace is needed and President [Joseph] Biden, because he is a very responsible, sensible people, so I don't think things will happen to greater ”, added the Mexican president.

“Do you hear anything from the UN? Do you hear something on the radio, do you see something on television, do you read something in the newspapers? Any. It is the agency I don't know what, that has already taken the statement of one of the Presidents or they have already bombed a bridge, or they have already sabotaged a gas pipeline, or there is a declaration that we are about to have someone press the button”, criticized L贸pez Obrador .

In September of this year, Russia exercised its veto right as a permanent member of the UN Security Council, to block a resolution similar to the one approved on October 12, 2022, for which a group of countries decided to present it to the General Assembly of the international organization, made up of a total of 193 members.

PUTIN ENACTS THE ANNEXATION OF UKRAINIAN TERRITORIES DONETSK, LUGANSK, KHERSON AND ZAPORIJIA

The President of Russia, Vladimir Vladimirovich Putin, promulgated the annexation to Russia of the Ukrainian regions of Donetsk, Lugansk, Kherson and Zaporizhia, according to two decrees published, on October 5, 2022, on the official Russian legal information portal.

Both chambers of the Russian Parliament previously approved the incorporation treaties of the four territories in Russia. For its part, the Senate yesterday approved the incorporation of these regions.

For his part, Kremlin spokesman Dmitri Peskov said that Putin had no plans to make a statement following the signing, or preside over a ceremony, as happened in 2014 with Crimea.

The Russian Foreign Minister, Sergey Lavrov, stressed that it is not important for Moscow that the West does not recognize the referendums on the incorporation of these territories into Russia, but they must "understand the new reality."

The incorporation of the Ukrainian territories will force the reform of article 65 of the Constitution, which includes 85 federal entities. Now there are 89, including Donetsk, Lugansk, Kherson and Zaporizhia.

The treaties establish that the official language in the new regions of this country will be Russian, although the use of Ukrainian will be allowed, as well as the national currency, the ruble.

Likewise, the people's republics of Donetsk and Lugansk, as well as the regions of Kherson and Zaporizhia, will maintain their name as new entities of the Russian Federation. The transition period for the full incorporation of the territories into Russia will last until January 1, 2026.

Russia used, on September 30, 2022, its veto right to stop in the Security Council of the United Nations Organization (UN), a resolution that sought to condemn the pseudo-referendums organized in four Ukrainian regions and their annexation, which violates international law.

The Russian delegation was left alone in its opposition to the text, which received the support of ten of the fifteen countries in the Security Council, while China, India, Brazil and Gabon abstained.

The resolution presented at the UN by the United States and Albania condemned the "illegal" referendums held in the four regions, in addition to not asking the international community not to recognize any change in their status and demanding the withdrawal of Russian troops from Ukraine.

The US ambassador, Linda Thomas-Greenfield, stressed that this type of situation is precisely what the Security Council was created for, so the body had a duty to act against these Russian movements and defend the principles of sovereignty and territorial integrity. on which the United Nations is based.

“You cannot go door to door and force people at gunpoint to vote for your fake referendum. One cannot forcibly seize the territory of another UN member state and declare it their own,” insisted Thomas-Greenfield, after the vote.

China noted that it believes "sovereignty and territorial integrity" should be respected, but again avoided openly criticizing Moscow and recalled that the "legitimate security concerns of all parties" must be taken into account, in a reference to Russian complaints about the expansion of the North Atlantic Treaty Organization (NATO)."

Mexico's UN Envoy Condemns Russia, AMLO Remains 'Neutral'

"Mexican Ambassador to the United Nations Juan Ram贸n de la Fuente on Monday, Oct. 10, criticized the annexation by Russia of four Ukrainian territories, and branded the act as illegal.

De la Fuente likewise announced that Mexico will vote in favor of a draft resolution in the UN General Assembly condemning Russia for annexing the four Ukrainian regions — Donetsk, Luhansk, Kherson and Zaporizhzhia — in September of this year.

Sponsored by 44 countries — which does not include Mexico — the draft resolution by the UN Security Council to condemn Russia for the annexations will be voted on in the General Assembly, after being vetoed by Russia.

“Mexico voted in favor of said draft resolution as an elected member of the Security Council, and we will do the same in this General Assembly,” De la Fuente said in a plenary session. “We will act based on our unwavering support and adherence to international law, in particular the prohibition of territorial expansion through the use of force, or other actions that contravene the Charter of the United Nations.”

On Sept. 30, Russia vetoed a UN Security Council resolution introduced by the United States and Albania condemning Moscow’s proclaimed annexation of parts of Ukraine. Russia, China’s strategic partner, abstained from the vote.

Russian President Vladimir Putin had proclaimed Russian rule over four regions that make up 15 percent of Ukraine’s territory — the largest annexation to date in Europe, since World War II. The move had been widely condemned by Western countries, as well as several of Russia’s close allies.

De la Fuente’s decision, however, is in direct contrast to Mexican President Andr茅s Manuel L贸pez Obrador’s (AMLO) recent statements, as he reiterated his “neutrality” on the Russian invasion of Ukraine.

“We won’t get involved in arguments,” L贸pez Obrador said in response to a journalist on Monday, Oct. 8, during his daily press conference at the National Palace in Mexico City. “They don’t meddle in our affairs, and we won’t meddle in anyone else’s. Mexico has a policy of neutrality, and what we want is a peaceful solution to that controversy, as established by our constitution.”

In the same press conference, L贸pez Obrador likewise insisted that an agreement between Mexico and Russia for “space research for peace purposes” does not have elements of espionage.

“It is a treaty that was signed last year, in September, before the war between Russia and Ukraine,” L贸pez Obrador said.

The Russian Embassy in Mexico, meanwhile, confirmed that an intergovernmental agreement has already been ratified for Mexico to use Russia’s Glonass satellite system — already operating in Nicaragua, Venezuela and Brazil, and which Washington believes is part of Moscow’s strategy to incorporate Latin America into its zone of influence — which Dolia Est茅vez, a Mexican journalist specializing in security issues, said has been used in other countries “for espionage purposes.”

According to the Kremlin, in a document posted on its official website, the Glonass satellite system “will develop an optical-electronic system to prevent dangerous space situations in Mexico.”

In February of this year, L贸pez Obrador tepidly “condemned” the war in Ukraine, and said that “Mexico is against any use of military force to resolve geopolitical disputes.” In September, Mykhailo Podolyak, chief advisor to Ukrainian President Volodymyr Zelensky, criticized AMLO of promoting a Russian political agenda to justify Moscow’s illegal invasion of Ukrainian territory, through the pretense of L贸pez Obrador’s so-called peace plan. At that time, Podolyak tweeted that AMLO’s peace plan is “a Russian plan.”

“There is a lot of propaganda going around, wanting to convince people that there are good guys and bad guys in this war. Everything becomes a scandal,” AMLO said on Monday, still speaking on the Russian-Ukrainian conflict. “Don’t get us into an argument.”
